As I discussed in Divorce in North Carolina, North Carolina is a no-fault state; however, North Carolina does have legal requirements to obtain divorce. One of those requirements is that the parties be separated for one year before filing for divorce.
Separation occurs when the parties live in separate residences and at least one of them intends that the separation be permanent. It is absolutely essential that the parties not live together.
While that might sound simple enough, military deployments and other separations not necessarily related to a party's intent to permanently separate can muddy the waters in contested cases. If you live in the Fayetteville area and you have questions about divorce, call for a free consultation.
